Electric diagnosis: State of L’interior installation D’electricity

Diagnosis of the electric installation (Decree No 2008-384 of April 22, 2008)

In the event of sale of a housing with use of dwelling, obligation to establish a diagnosis of the electric installation, if this one has more than 15 years. In joint ownership, alone is concerned the privative part. In the event of absence of the diagnosis at the time of the signature of the notarial act: impossibility for the salesman of exonerating guarantee of the hidden defects. This measurement will come into effect at January 1, 2009.

Decree No 2008-384 of 22 April 2008 relative to L’state of L’interior installation D’electricity in the buildings with use D’dwelling

Article R. * 134-10. − L’state of L’interior installation D’electricity envisaged with L’article L. 134-7 is realized in the privative parts of the buildings with use D’dwelling and their dependences, downstream from L’general apparatus of ordering and protection of L’specific electric installation to each housing, jusqu’at the boundaries D’food or jusqu’with the bases of the socket-outlets. L’state of L’interior installation D’electricity also relates on L’adequacy of the fixed equipment to the characteristics of the network and to the conditions of their installation in comparison with the requirements of safety.

Article R. 134-11. − L’state of L’interior installation D’electricity raises L’existence and describes, in comparison with the requirements of safety, the characteristics:
– D’a general apparatus of order and protection and its accessibility;
– D’at least a differential device of sensitivity suitable with the conditions of earthing, to L’origin of L’electric installation;
– D’a device safety against the overcurrents adapted to the section of the drivers, on each circuit;
– D’an equipotential connection and D’an electric installation adapted to the particular conditions of the buildings containing a bath-tub or a shower.

L’state of L’interior installation D’electricity identifies:
– electric materials unsuited to L’use or presenting risks of direct contacts with elements under tension;
– not mechanically protected drivers.
L’state of L’interior installation D’electricity is established according to the methodological requirements and the model defined by joint decree of the ministers in charge of construction and L’energy.

Article R. 134-12. − To carry out L’state of L’interior installation D’electricity, it is called upon a person answering the conditions of L’article L. 271-6.

Article R. * 134-13. − Lorsqu’an interior installation D’electricity made L’object D’a certificate of conformity aimed by an approved organization by the minister charged with L’energy pursuant to the decree No 72-1120 with December 14, 1972, this certificate, or, failing this, when L’certificate cannot be presented, the declaration
L’approved organization indicating qu’it aimed at a certificate well, holds place D’state of L’indoor electrical equipment envisaged by L’article L. 134-7, if L’certificate were established since less than three years at the date on which this document must be produced.

Art. 2. − The articles R. 134-10 with R. 134-13 of the code of construction and L’dwelling come into effect on January 1, 2009.

Art. 3. − A diagnosis, carried out before L’come into effect of this decree within the framework D’operations organized by distributors D’electricity and whose list is defined by decree of the minister charged with L’energy, is considered equivalent to L’state of L’interior installation D’electricity envisaged with L’article R. 134-11, S’it was carried out since less than three years at the date on which this document must be produced.

Art. 4. − The minister D’State, minister of L’ecology, L’energy, the durable development and L’regional planning, and the Minister for housing and the city are charged, each one in what relates to it, of L’execution of this decree, which will be published with the Journal officiel de la République française.
